Product Liability

Product Liability – DID YOU KNOW 1. If you have been injured because of a defective product, it is imperative that you keep the product if it has not been destroyed or repossessed by the manufacturer.

2. If you destroy the product that caused your injury, the following problems may arise:

a. The judge may instruct the jury that your destruction of the product gives rise to a negative inference.

b. It can be very difficult to prove your case if the attorney cannot show what the product looks like. In fact, without the product, a judge may rule that there is not enough evidence for a jury to reasonably decide the case.

c. It can be impossible to compare the defective product to a working product

d. If it is a case of inadequate warning, it can be difficult to prove to a jury that the warning was inadequate, and it allows a jury to believe that the warning was there and wore away over time.

3. It may be impossible to keep the defective product if it has been destroyed, however, you should salvage as much evidence and/or remains of the product for your attorney to show to an expert and preserve it for trial.
